Dr Anoop Rastogi
Cosmetic surgeon and former patient/blogger in Supreme Court legal wrangle! Dispute over blog.
On the 20th August 2008, Dr Anoop Rastogi, who is a high profile GP cosmetic surgeon, well known for his strong Internet presence, and appearances on 'Mornings With Kerri-Anne' sought a Supreme Court injunction, against me, in the following terms, on an ex parte basis.
Order that until further order, the defendant be restrained by herself, her servants or agents from directly or indirectly publishing in any form any statements of or concerning the plaintiff to the effect that he is reckless, negligent or dishonest in his profession as a cosmetic surgeon, that he did not perform the defendant’s cosmetic surgery correctly or allegations of a similar nature other than to:
A. Any organisation with proper responsibility for considering and determining complaints concerning the conduct of the plaintiff
B. As may be required by law;
C. To professional advisors for the purpose of obtaining professional advice; or
D. With the leave of the Court.
I have given Dr Rastogi, and the court, written notice that it is my intention to fight this order, on the basis that it is unjust, unfair and unreasonable and may prevent me from operating my right to lawful comment concerning Dr Rastogi's activities and substantial body of publications in the public domain and especially on the Internet.
My blog Cosmetic Surgery Consumer Alert! The Nolan Report at www.thenolanreport.blogspot.com has now been removed in full from Internet publication by a third party, also effected by the orders. For his part Dr Rastogi alleges defamation with malice (which I deny) in a statement of claim which outlines complaints about some of the contents of Cosmetic Surgery Consumer Alert! and some of the contents its sister ship Cosmetic Surgery Consumer Alert Articles.
I currently seek legal help to fight these actions.
